Slip and Fall and Occupiers Liability Cases

Slip and fall cases generally occur when a person slips or trips and falls as a result of a premise not being maintained in a reasonably safe condition. Under The Occupiers’ Liability Act, C.C.S.M., c. O8 of Manitoba, parties that have physical possession of a premise or who have the responsibility for and control over the condition of the premise, owe a duty of care to persons who enter the premise to take such care, as is reasonable in the circumstances, to see that the person will be reasonably safe while on the premise. In the case of City, Municipal or Government owned property, there are short notice periods that must be complied with in order to advance a successful claim.
